TERMS & CONDITIONS

 

DEFINITIONS

For the purposes of these terms and conditions:

  • “Owner” refers to Adelaide Wedding Hire.
  • “Hirer” refers to the person/s or entity hiring equipment from Adelaide Wedding Hire.
  • “Equipment” refers to all goods and accessories supplied to the hiree.
  • “Terms” means these terms and conditions of hire.

DISCLAIMER

  • The Hirer accepts full responsibility for the use and or operation of the hire Equipment and hereby agrees to release and fully indemnify the Owner against any third-party claims, actions, demands, suits, costs, and expenses for damage or injury or death to a person or persons or animals or property arising directly or indirectly out of the hire or use of the Equipment by the Hirer or persons associated with the Hirer.

CONDITIONS OF HIRE

  • The hiring of Equipment will commence on the specified date outlined in the Hirer's invoice. The standard hire period is for up to 5 days from the commencement date. Any extension of the hire period beyond that must be negotiated directly with the Owner. Extensions are subject to mutual agreement between the Owner and the Hirer and may be subject to additional fees or terms as determined by the Owner. The Owner reserves the right to decline any extension request. 
  • The Hirer accepts full responsibility to return all Equipment at the end of the hire period. If the Hirer does not return Equipment at the end of this period, the charged amount will continue to accrue at the same hire rate as stated on the invoice until the day on which the Equipment is returned complete and undamaged.
  • The Hirer accepts that sufficient instruction has been received on the correct setup, use and pack down of Equipment hired from the Owner. Upon the Equipment being delivered by the Owner or picked up by the Hirer, it is incumbent upon the Hirer to manage and operate the Equipment diligently, securely, and with due care. The Equipment should only be utilized for its intended purpose and within the specified capacity for which it was designed.The Hirer is responsible for all Equipment being returned in the same condition as it was received.
  • The Hirer commits to refraining from making any modifications or permanent attachments to the Equipment for personal use while it is on hire and agrees to return the Equipment in the same condition as it was received. The full replacement cost at the current market value will be charged to the Hirer for any lost, damaged, broken, or stolen Equipment, or any associated piece and packaging during the hire period.

PAYMENT

  • The Hirer agrees to pay the Owner the hire fee specified in the invoice for the hire period of the Equipment.
  • A non-refundable deposit is required to be paid by the Hirer within 7 days from receiving the invoice to secure the hire of Equipment for the requested date. If payment is not made within that period, the Owner cannot guarantee that all items will be available for the event date and the Hirer will lose the booking.
  • The remaining balance of the agreed hire fee is to be paid 30 days prior to the delivery or pickup of Equipment. 
  • If full payment is not received and cleared prior to the scheduled delivery the Owner may withhold delivery and a further delivery cost may be incurred if rescheduled.
  • Payment for hire of Equipment can be made by bank transfer, credit card or cash and all prices are in Australian Dollars (AUD). Cheques, in any form, are not accepted.

DAMAGE WAIVER FEE

  • The Owner requests a compulsory and non-refundable Damage Waiver fee of 7% which is added to the total amount of the invoice.
  • The Damage Waiver fee alleviates the financial responsibility of the Hirer for any damages to the hired Equipment, except in cases where the hire terms and conditions are breached in another way. Should the damage surpass a value equivalent to 7% of the hire, the Hirer is obligated to cover the entire cost of repairing or replacing the Equipment.  This cost will be calculated at the Owner's discretion and will be invoiced to the Hirer for immediate payment.
  • If any Equipment is damaged during the hire period, the Hirer must still return the items to the Owner, otherwise they will be classed as missing goods and charged at full replacement cost.

CANCELLATION AND CHANGES

  • Cancellations and changes to the hire of Equipment must be in writing, preferably email, to the Owner.
  • If the Hirer decides to change or cancel the Equipment hire more than 4 weeks before the designated event date, a partial refund of the invoice value will be issued. This refund will exclude the 20% deposit and will be issued to the bank details supplied to the Owner by the Hirer in writing.
  • If the Hirer opts to change or cancel the Equipment hire between 2 to 4 weeks before the designated event date, a partial refund of the invoice value will be issued. This refund will exclude the 20% deposit and 50% of the remaining balance that exceeds the required deposit amount. The refund will be issued to the bank details supplied to the Owner by the Hirer in writing.
  • If the Hirer chooses to change or cancel the Equipment hire within 0 days to 2 weeks before the specified event date, the entire payment of the invoice value will be forfeited.

LINEN AND CENTERPIECES CONDITIONS

  • Table linen and napkins are to be returned washed and free of any food residue.
  • Glass cylinders are to be returned washed and free of any wax or flowers residue.
  • A cleaning fee will be calculated at the Owner's discretion for returns not meeting cleanliness standards and will be invoiced to the Hirer for immediate payment.

GLASSWARE, CUTLERY AND CROCKERY CONDITIONS

  • The Owner is to ensure that all glassware, cutlery, and crockery are thoroughly sanitized before dispatch.
  • Glassware is to be returned washed, free of any liquid residue and in the designated carton they were received in. 
  • Cutlery is to be returned washed, free of any food residue and placed in the same container they were received in. 
  • Crockery is to be returned washed, free of any food residue and placed in the same container they were received in. 
  • Charger plates are decorative pieces only and are not intended to be used for eating. Any food residue that falls onto the charger plates must be cleaned prior to return.
  • A cleaning fee will be calculated at the Owner's discretion for returns not meeting cleanliness standards and will be invoiced to the Hirer for immediate payment.

FOOD CATERING EQUIPMENT CONDITIONS

  • The Owner is to ensure that all food catering Equipment is sanitized before dispatch.
  • The Equipment is to be returned cleaned and free of any food or liquid residue.
  • A cleaning fee will be calculated at the Owner's discretion for returns not meeting cleanliness standards and will be invoiced to the Hirer for immediate payment.

FLORAL ARRANGEMENT CONDITIONS

  • The Owner cannot be held responsible for any discrepancies in color or design between the floral arrangements received and the photos displayed on the Owner's website. The flower arrangements are crafted with artificial flowers and may experience changes over time as missing or broken pieces are replaced. Additionally, variations in Equipment color may occur due to lighting conditions in the photos.

UMBRELLAS AND MARQUEES

  • In windy conditions the umbrealls and marquees must be closed to prevent injuries and damages. The Owner cannot be held responsible for any damages or injuries
PAVILLIONS

  • Pavilions are temporary and the company is not liable for weather-related damage.
  • In severe weather, occupants must evacuate for safety. The client is responsible for monitoring conditions.
  • Pavilions must not be altered or moved without consent. The client is responsible for people and property inside.
  • Only approved personnel can install or remove the pavilion. Clear access must be provided.

LED REAL WAX CANDLES

  • LED real wax candles must be stored in cool dry conditions. The Owner cannot be held responsible for any damages.

EQUIPMENT FAULT

  • In the event that any Equipment becomes unsafe or shows signs of damage during the hire period, the Hirer is required to discontinue its use immediately. The Hirer must promptly notify the Owner to prevent any potential injury or further damages that may arise from continued use after the detection of damaged or unsafe equipment.
  • The Hirer should not attempt to repair the hired equipment without first consulting the Owner and obtaining explicit approval to do so.

ACCEPTANCE OF TERMS AND CONDITIONS

  • Upon preceding with the booking and making the payment, the Hirer acknowledges and unconditionally accepts these Terms and Conditions. This acceptance is a contingent process that is fully understood and confirmed by the Hirer upon taking possession of the Equipment from the Owner.
